Terms of Service

1. Agreement

By accessing or using FaceScale (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding contract between you and the operator of FaceScale ("we", "us", "our").

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use FaceScale. By using the Service you represent that you meet this requirement and that all information you provide is accurate.

3. Nature of the Service

FaceScale provides AI-generated aesthetic and structural facial analysis for entertainment, self-improvement and informational purposes only. Results are subjective estimates produced by automated models and do not constitute medical, psychological, dermatological, cosmetic, or professional advice of any kind. Do not rely on FaceScale to make health, surgical, financial, or life decisions.

4. Your Content

You retain ownership of photos and content you upload. You grant us a limited, worldwide, royalty-free license to process, store, and analyze your content solely to operate, secure, and improve the Service. You represent that you have all rights necessary to upload the content you submit and that it does not infringe any third-party rights.

You agree NOT to upload:

• Photos of minors that you are not the parent or legal guardian of.
• Photos of any person without their consent.
• Sexually explicit, violent, hateful, or unlawful content.
• Content that violates the rights of any third party.

5. Acceptable Use

You agree not to:

• Reverse engineer, scrape, or attempt to extract source code or models.
• Use the Service to harass, defame, or harm any person.
• Resell, sublicense, or commercially exploit results without written permission.
• Bypass paywalls, share premium accounts, or abuse promotional offers.
• Interfere with the security or integrity of the Service.

We may suspend or terminate accounts that violate these rules at our sole discretion.

6. Premium, Payments & No Refunds

FaceScale Premium is a paid plan offering additional features. Pricing and features are described on our pricing page and may change for new purchases at any time. Payments are processed through third-party providers (including cryptocurrency processors). You are responsible for any network fees, taxes, or currency conversion costs.

All purchases are final. We do not offer refunds, returns, chargebacks, partial credits, or cancellations for any reason, including but not limited to unused time, change of mind, dissatisfaction with results, accidental purchases, or duplicate purchases. By completing a purchase you expressly acknowledge and agree to this no-refund, no-cancellation policy and waive any statutory cooling-off rights to the maximum extent permitted by applicable law.

Premium access is granted for the term you paid for and ends at the end of that term unless renewed. Initiating a chargeback or payment dispute without first contacting us in good faith is a material breach of these Terms and may result in immediate termination of your account and forfeiture of any remaining access.

7. Intellectual Property

The Service, including its software, design, branding, models, and content (excluding your uploaded content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation.

We do not warrant that results are accurate, complete, reliable, or suitable for any specific purpose. Aesthetic ratings are inherently subjective. We are not responsible for any decisions you make based on results from the Service.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall we, our affiliates, officers, employees, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or emotional distress, arising out of or related to your use of the service, even if advised of the possibility.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the three (3) months preceding the event giving rise to the claim, or (b) USD $20.

10. Indemnification

You agree to defend, indemnify, and hold harmless FaceScale and its operators from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law or third-party right.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including payment, disclaimers, liability limits, indemnity, and dispute resolution) will survive.

12. Changes to the Service or Terms

We may modify or discontinue the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the competent courts of that jurisdiction, and you consent to personal jurisdiction there. You agree to bring any claim only on an individual basis and waive any right to participate in a class or representative action.
